What happens when the president uses such law bending for his own purposes? A business man is accused of providing aid to terrorists and he just happens to be a political opponent. no trial? No opportunity to clear the charges? What happens if you are accused, held indefinitely without charges?

Obama himself has admitted some of the Gitmo Detainees are Not able to be Tried, but are Too Dangerous to just let go, what do you suggest we do with those individuals?

the Geneva conventions, which the US ratified and thus are the law, control this.trials are held by the military, using military procedures. evidence need not be made public. if found guilty of the crimes detailed in the conventions, the penalties permissible include death or lifetime incarceration, or such lesser penalty as the court shall decide.civilian trials are not provided for in the Geneva conventions and should not be held.

Remember, though, Guantanamo came from Cheney and Bush.
